Lawsuits for School Bus Accidents in Texas

You may be able to sue your Texas school district if a school bus crash caused your child a significant loss or injury. However, you must act quickly to file a notice of claim with the district within a strict deadline. A successful lawsuit requires proof that the school district’s negligence caused the harm. It also requires a qualified lawyer to navigate the complex process of filing the claim and seeking compensation for damages, such as medical bills, pain, and suffering.

You must first determine if you have a valid claim. That means you must have suffered a concrete loss or injury as a direct result of the bus incident. If your child got off the bus safely, you likely have no grounds for a lawsuit.

You also need to show that the school district’s or driver’s actions were negligent, meaning they failed to act with reasonable care. Before considering a lawsuit, inform the principal, the director of transportation, and any other relevant school officials to explain the incident and demand a plan to prevent future occurrences.

File a Notice of Claim

Because you are suing a government entity, you must file a formal notice of claim with the school district within a specific timeframe, which can be very short (as little as 30 days in some places). The notice of claim should describe the incident, how the school was at fault, the injuries suffered by your child, and the compensation you are seeking.

Leander ISD school bus crash injures 17

TRAVIS COUNTY — An August 13 Leander ISD school bus crash resulted in 17 people being taken to the hospital, including 16 children and the bus driver. Authorities say the single-vehicle accident happened around 3:15 p.m. in the 22300 block of Nameless Rd. near Sandy Creek.

The bus was coming from Bagdad Elementary School when the driver lost control of the vehicle. Dash cam video released by the district shows the bus drift over the center line, before drifting back to the right and eventually veering off the right side of the road and rolling over on its side. It then goes on to show bystanders helping to pull the driver and the children out of the bus.

A total of 42 children and one adult (the driver) were on the bus when the crash occurred.  According to an investigation, the bus was traveling at 45 mph at the time of the crash.

Leander ISD officials told local media that the bus driver, Tim Gall, was placed on paid administrative leave while the Texas Department of Public Safety (DPS) continued investigating the incident. Gall was later cited for failure to drive in a single lane and not wearing his safety belt. Criminal charges were not expected to the filed.

Everyone who was taken to the hospital following the crash was released the following day, according to the district.
