What is required in Order to Receive Compensation for Auto-pedestrian Injuries?

In order to receive compensation for a pedestrian personal injury claim, the victim must prove another party committed a wrongful (negligent) action, and that action caused the injuries and damages at issue.

The key steps include getting medical help, reporting the accident to law enforcement, gathering evidence (photos, witness information), and potentially hiring an attorney to help file, and negotiate the claim with the insurance company.

What is a Pedestrian Accident Claim?

A pedestrian accident claim is a legal claim filed by an injured pedestrian to recover compensation certain losses that were caused by someone else’s fault. The claim must demonstrate that another person or entity acted carelessly or violated a duty, which resulted in the4 victim’s injuries.

Steps to File a Claim

Seek Immediate Medical Attention:

Even for seemingly minor injuries, it is crucial that the victim obtain medical documentation. The victim must also be able to link the injuries to the accident in question, and to the negligence of the defendant.

Report the Accident:

Law enforcement should be contacted to ensure a police report is filed. The report will serve as critical evidence. The report will contain key details about the accident scene, and the vehicle involved.

Collect other Evidence:

Obtain the names and contact information of any bystanders who happened to witness the accident in question. Reliable witness testimony can carry a lot of weight in supporting the claim.
