Let’s discuss jurisdiction in Texas wrongful death cases
In Texas, wrongful death civil trials are primarily heard in state civil courts. Laws vary significantly from state to state, and we can discuss that in another blog.
Wrongful death lawsuits can sometimes be filed in a federal court if the case involves federal law in some way. Examples include civil rights violations by law enforcement and certain cross-border situations.
Factors like the location of the incident, the defendant’s residence, or where the plaintiff lived at the time of the incident often determine the specific state and county where a lawsuit can be filed.
State vs. Federal jurisdiction
State Court: Most wrongful death cases, including those resulting from car accidents or medical malpractice, are handled in state court.
Federal Court: Federal jurisdiction is rare in these cases but can apply if the claim is based on a federal law or if the defendant is from another country or is a federal entity, like a police officer accused of a civil rights violation.
Determining the correct court
Location: The lawsuit is often filed in the county where the wrongful act occurred.
Defendant’s residence: The case may be brought in the county where the defendant lives or where their business is located.
Plaintiff’s residence: If the above options don’t apply, the case can sometimes be filed in the county where the plaintiff lived when the incident happened.
Key legal considerations
State-specific laws: Each state has its own laws regarding wrongful death claims, including who can sue, the statute of limitations (the deadline for filing), and the types of damages that can be sought.
Statute of limitations: This varies by state but typically starts from the date of death. The time limit can be as short as one year, making it crucial to consult an attorney immediately.
Eligibility: State laws determine who is considered a qualified “heir” to bring a claim, such as a surviving spouse, children, parents, or even more distant relatives in some cases.
Legal precedent: Decisions from higher courts in a specific state can set precedents that determine who is eligible to file and how damages are calculated in future cases within that state.

Beaumont highway crash claims one life

HOUSTON — Houston police say the Beaumont Highway between Oates and Mesa has reopened. The roadway was closed for several hours as authorities investigated a crash that took the life of one woman.
According to the Houston Police Department, the crash happened November 14 just before 4:30 a.m. A police department news release states that a woman in her 30s was driving eastward just before the crash. The report states the woman’s vehicle veered off the highway, and crossed a grassy median into oncoming traffic lanes.
The woman’s car was struck by an 18-wheel tractor-trailer, killing. There was no indication in the news release that the truck driver was injured in the crash.
