How are civil claims handled when multiple people are killed or injured by one at-fault driver?

By: Benjamin Treviño

When more than one person is killed or injured by one at-fault driver, victims can file separate civil claims or join together against the driver’s insurance policy.

If damages exceed policy limits, compensation is divided proportionally, often requiring legal representation to handle limited funds and complex negotiations. Here are the key points to remember about multiple-victim civil claims.

Insurance Limits

Different insurance policies will have different limits on per person/per accident scenarios. If one person’s injuries are severe, they might exhaust the per-person limit, reducing

available funds for others.

Competing Claims

When multiple victims exist, all claims are filed against the same, limited policy. If damages exceed coverage, insurance companies may require a combined settlement where funds are distributed proportionally.

Legal Action Options

Injured passengers and other drivers can sue the at-fault driver for negligence, covering medical expenses, lost wages, and pain and suffering.

Wrongful Death vs. Personal Injury

If one person is killed and another is injured in the same crash, the claims compete for the same limited insurance policy funds.

The wrongful death claim does not automatically take legal priority over a personal injury claim. However, it often commands higher damages and prioritization in settlement negotiations due to the severity of the loss.

Competition for Funds

If the total damages for both the wrongful death and the personal injury exceed the defendant’s insurance policy limits, they may be paid on a pro-rata basis or through a negotiated settlement, rather than one automatically taking precedence.

Case Separation

These are distinct legal claims. The wrongful death claim represents the family’s loss, while the personal injury claim represents the surviving person’s pain and medical expenses.

Strategic Handling

Insurance companies often want to handle all cases together, but attorneys for the victims will negotiate how the limited insurance pool is distributed.

In cases of limited insurance, the families and victims may need to seek compensation from the defendant’s personal assets if the policy is exhausted.

A Cameron County man is facing criminal charges in connection with an April 25 crash that killed one woman and injured another.

According to a Texas Department of Public Safety news release, the crash occurred at around 5:07 a.m. on U.S. 77 south of Orphanage Road. The report states a green Chevrolet Camaro was traveling north in a southbound lane of Highway 77.

A silver Honda Accord carrying two females was traveling south on the same highway and crashed head-on with the Camaro.

A passenger in the Accord, identified as 53-year-old Adelaida Gomez of Conroe, died at the scene from her injuries. The Accord driver’s condition and identity were not immediately available.

The DPS report identifies the Camaro’s driver as 22-year-old Joey Gael Estrada. He was transported to Valley Baptist Medical Center in Harlingen “for medical clearance,” and was arrested for criminal negligent homicide and possession of a controlled substance following his release.

As of this report, Estrada was being held at the Carrizales-Rucker Detention Center.

Troopers are continuing to investigate the crash.
