Establishing fault without eyewitnesses

When there are no eyewitnesses to a car crash, and there are conflicting narratives about what happened, investigators can analyze objective physical and digital evidence in an effort to establish fault in the collision.

Insurance companies, police investigators, and personal injury attorneys will use these indicators to reconstruct the sequence of events and determine negligence to the furthest extent possible.

Key Evidence for Proving Fault

Police Reports

Responding officers act as neutral investigators. Their reports include vehicle positions, diagrams, and potential traffic citations that serve as an authoritative foundation for your claim.

Vehicle Damage Analysis

The location and severity of impact can indicate how a crash occurred. For example, front-to-rear damage typically points to a rear-end collision, where the rear driver is usually presumed at fault.

Dashcams & Surveillance

Today’s technology means there are video cameras almost everywhere. The latest automobiles can be equipped with cameras. Surveillance cameras are located at many businesses. Some urban intersections are equipped with cameras for monitoring traffic.

If any one of these cameras is recording what it sees, that recording can provide an unbiased account of what transpired at the crash site.

Event Data Recorders

Some modern cars utilize “black box” technology to store data on the speed, braking activity, and steering angles of the vehicle just before impact.

Cell Phone Records

These can be used to prove distracted driving if a driver was active on their phone at the time of the crash.

Physical Scene Evidence

Tire skid marks can be measured to indicate a driver’s braking time, speed, and reaction. The debris patterns of shattered glass or car parts can reveal the exact point of impact.

Accident reconstruction experts can be retained to use their forensic techniques and computer simulations to piece together speed, trajectory, and impact points.

Medical records can also yield information about the crash: Injury patterns often correlate with specific crash dynamics, such as whiplash in rear-end collisions.

Critical Steps to Take

Call the police. Make sure an official police report is filed immediately to document the scene. Take extensive photos of vehicle damage, road conditions, traffic signals, and skid marks from multiple angles.

Your attorney can send “preservation letters” to nearby businesses to ensure surveillance footage isn’t overwritten.

Lastly, avoid admitting fault. Do not apologize or admit guilt at the scene, as these statements can be used against you by insurance adjusters.
