Personal Injury, Wrongful Death, and Off-road Vehicle Crashes
Because of their open-body design, off-road vehicle crashes can result in serious personal injuries like traumatic brain injuries, spinal cord injuries, broken bones, and amputations.
In the aftermath, it is crucial to seek immediate medical attention, document the accident scene and conditions, report the incident to authorities, and consult with an attorney to navigate liability and insurance complexities.
Common injuries resulting from off-road vehicle crashes are numerous and often fatal. They include:
- Traumatic brain injuries (TBIs)
- Spinal cord injuries and paralysis
- Broken or dislocated bones
- Internal organ damage
- Severe lacerations or amputations
- Skull fractures
Immediate steps to take after a crash
Seek immediate medical attention: Even if injuries seem minor, get a medical evaluation to check for hidden issues like head or spinal trauma.
Document everything: Take photos of the scene, the vehicle, and your injuries. Record weather conditions and trail conditions.
Report the incident: Notify local law enforcement and any relevant authorities or property owners.
Gather evidence: Collect witness information and secure medical records. This will be vital for any future legal or insurance claims.
Legal and insurance considerations
Determine liability: Proving fault can be complex as off-road accidents often occur on private property and are not subject to standard traffic laws.
Understand insurance: Standard auto insurance may not cover off-road vehicle accidents, so it’s important to check the specific policy for coverage.
File a claim: You may be able to file a claim against the at-fault driver’s insurance or your own uninsured/underinsured motorist policy.

Edinburg man dead following off-road vehicle crash
By: Benjamin Treviño
The Texas Department of Public Safety is investigating an October 25 crash involving an off-road vehicle that left a 25-year-old Edinburg man dead.
DPS identified the victim as Juan Antonio Villasana.
According to a news release, the crash occurred at about 8:33 p.m. on east Ingle Road north of Jasman Road north of Edinburg.
According to DPS a preliminary investigation report, a Can-Am Maverick side-by-side vehicle occupied by a male driver and Villasana, was traveling westward on east Ingle Road.
A Nissan Kicks, occupied by a male driver, was also traveling west on the same road behind the Can-Am, said the report.
“The driver of the Nissan attempted to pass the Can-Am on the left side and collided with the Can-Am,” the news release stated. “Emergency medical services evaluated both drivers for injuries, and they were not transported to the hospital.”
DPS said Villasana died from his injuries at the scene, adding that troopers are investigating the crash.
