Can I file a personal injury claim for a stabbing?

Yes, you can pursue a personal injury claim after a stabbing. The objective of such an action would be to recover compensation for your losses. These include medical bills to treat your injuries, lost wages, and pain and suffering.

Your civil claim would be separate from any criminal case that arises against the defendant.

You may sue the individual who stabbed you, or potentially the property owner or business where the incident occurred if negligence, such as a lack of security, contributed to the stabbing.

Who to Sue?

The Attacker: You can sue the person who stabbed you for damages, though their ability to pay may be limited.

Property Owners/Businesses: If the stabbing happened on someone else’s property (like a bar or business), you might have a case against them for failing to provide adequate security or for other forms of negligence that led to the attack.

Criminal Restitution: You can also explore the possibility of restitution from the criminal court if the attacker is charged and convicted. Contact Victim Advocacy Programs to explore available funds to victims of violent crimes.

What You Can Claim

Medical Expenses: Costs for emergency care, hospital stays, treatments, and future medical needs.

Lost Wages: Compensation for the income you’ve lost due to your inability to work.

Pain and Suffering: Damages for the physical pain, emotional distress, and psychological trauma caused by the attack.

Other Damages: Other costs incurred as a direct result of the stabbing.

Steps to Take

First, seek medical attention, because your health is the priority. Next, report the incident to the police. Failure to seek criminal prosecution could weaken your claim to civil compensation. Finally, gather evidence by collecting any medical reports, bills, and witness information.

A 46-year-old Edinburg man is in custody, accused of stabbing someone in the stomach during a road rage confrontation.

In a City of Edinburg news release, the city said police are investigating the incident that happened September 11 shortly before 6:00 p.m.

Preliminary reports indicate the incident began when a white Ford F-150 and a white Ford Tauras were following each other before coming to a stop near the intersection of 12th Avenue and Samano Street, according to the release.

“Both drivers exited their vehicle and engaged in a verbal altercation,” the release stated. “During the dispute, the suspect allegedly brandished a knife and stabbed the victim once in the stomach area before fleeing north on 12th Avenue.”

The victim drove to the police department to report the incident and EMS was dispatched and took them to a hospital with injuries that are not life-threatening.

A search ensued and at approximately 10:20 p.m. Thursday police arrested Alexis Garcia at his residence in the 900 block of S. 20th Street.

He is charged with aggravated assault, according to the release.
