How motherhood can affect a wrongful death settlement.

While courts acknowledge that every human life is invaluable, there are structured legal frameworks to assign a monetary value for compensation in wrongful death cases.

Compensation is not meant to be a “price tag” on the person’s value, but a way to compensate survivors for the specific losses they suffer because the person is gone.

The available data show that wrongful death settlements involving mothers often result in higher settlements, especially when the victim leaves behind young children.

Key Reasons for Higher Settlements

Loss of Services & Care

Even if a mother was a stay-at-home parent, her loss is calculated by the high cost of replacing her daily care, guidance, and household management, which often results in substantial compensation.

Minor Children

The presence of minor children significantly increases the valuation of a claim due to the long-term loss of nurture, education, and financial support

Non-Economic Damages

Juries often award significant damages for the loss of companionship, love, and emotional support, which are heavily weighted when a mother dies.

Financial Dependency

If the spouse was financially dependent, or if the household relied on her income, that amount is calculated over a lifetime.

Factors Affecting the Amount

Individual Loss

Each family member’s loss is calculated individually. While a mother’s death often results in high damages, the ultimate settlement amount depends on the specific, unique facts of the case, and the skills of the attorney.

Woman dies, two children hurt in Edinburg crash

EDINBURG – A truck driver is facing multiple charges following a crash that killed a woman and injured two of her children. 31-year-old Miguel Angel Suarez is charged with intoxication manslaughter, and four counts of intoxication assault.

The charges stem from a May 2 crash at the intersection of Salinas Street and West Monte Cristo Road in Edinburg.

According to a City of Edinburg spokesperson, Suarez was allegedly intoxicated as he was traveling west on Monte Christo Road. Suarez reportedly ran a red light and his vehicle crashed into a car driven by 39-year-old Martha Luna Miranda as she was entering the intersection.

Miranda was pronounced dead at the scene. Her husband and a 4-year-old daughter were treated at a hospital and released.

Two sons, ages 9 and 5, were transported to a San Antonio facility “for further treatment.”

Their condition remains unclear and the investigation into the crash continues.

“This is a heartbreaking tragedy, especially because it involves children,” police Chief Jaime Ayala said in a news release. “We urge everyone to make responsible choices — plan ahead, designate a driver, and never get behind the wheel while impaired.”
