How long will it take to settle my wrongful death case?
This is a question with no easy answer, because the timeframe for settling a wrongful death case can vary significantly based on the complexity of the case, and whether it goes to trial.
A straightforward claim with clear liability might be resolved in as few as six to 12 months. More contentious or complex litigation can last three to four years or longer.
A Process Overview
The process of seeking compensation for a wrongful death is generally broken down into the phases listed below. Timeframes vary greatly as they will be dictated by the facts of each case.
Investigation and Filing (1–6 months)
During this initial phase, attorneys gather evidence such as police reports, medical records, and witness statements before formally filing the “Petition” or complaint.
Discovery (6 months – 2+ years)
This is often the longest stage, where both sides exchange evidence and conduct depositions (questioning witnesses under oath).
Mediation and Negotiation (3–9 months)
Many cases are resolved through mediation, which typically occurs after discovery when both sides have a clearer view of the case’s value.
Trial and Verdict (1–4 weeks for trial)
If no settlement is reached, the case moves to trial. However, waiting for a court date can add 12–24 months to the overall timeline due to court backlogs.
Appeals (1–2+ years)
If a verdict is reached but then appealed by either party, it can extend the final resolution by several more years.
Key Factors Influencing Duration of Cases
Cases where fault is obvious (e.g., a DUI crash) often settle faster than those with disputed liability or multiple at-fault parties.
If the insurance company is willing to negotiate a fair offer early, the case may resolve in months. If they offer “lowball” amounts, litigation becomes necessary, and it extends the time it takes to reach a resolution.
Calculating future lost income, loss of companionship, and medical expenses (especially for younger victims) requires expert testimony that takes time to prepare.
Greater volumes of cases in your local jurisdiction can cause “interminable” delays simply waiting for a judge or jury to be available.

Police make arrest in two-year-old fatal crash
By: Benjamin Treviño
Edinburg police have arrested a 48-year-old driver who is accused of causing a crash that killed four people.
Sheng Li Jiang was taken into custody at a nursing and rehabilitation center where he had been undergoing treatment for his crash-related injuries. He was arrested after receiving medical clearance, and has been charged with four counts of intoxication manslaughter.
The charges stem from a July 24, 2023 crash in the 1800 block of S. Jackson Road. Jiang is accused of driving while intoxicated, losing control of his vehicle, and slamming into a minivan.
The minivan driver, 50-year-old Luz Aurora Casado, died at the scene.
Three members of her family in the minivan died later in a hospital. They included Casado’s mother, Maria Guadalupe Zavala Casado, 68; her niece, Shailey Rachel Martinez, 10; and her granddaughter, 2-year-old Elliena Santoy.
Jiang is scheduled to be formally arraigned on the charges on Wednesday, March 11, 2026, according to the 430th District Court.
