What happens to a personal injury car crash claim if the negligent party dies?

If the negligent party in a car crash dies, the injured party (plaintiff) generally retains the right to seek compensation for their injuries. The death of the at-fault driver does not negate that driver’s liability. However, it does change the legal target of the claim from the individual to their insurance policy or their legal estate.

Primary Recovery Options

The first option is the at-fault driver’s Insurance. The deceased driver’s auto insurance policy typically remains active for accidents that occurred while it was in force. The insurer is still legally obligated to handle, investigate, and potentially settle valid claims up to the policy’s limits.

Another option is to make a claim against the deceased driver’s estate. This option can be sought if the driver was uninsured or if your damages exceed their insurance limits. This involves the probate court process, where the estate’s assets ( bank accounts, property, etc.) may be used to pay off debts and liabilities. This includes a plaintiff’s personal injury damages.

Man dies in crash near Alton

The Texas Department of Public Safety is investigating a March 15 crash that claimed the life of one man. According to a DPS news release, the crash happened at approximately 11:14 p.m. on Moore Field Road north of the Mile 8 Road intersection. The crash site is roughly five miles north of Alton.

DPS has identified the victim as 42-year-old Alejandro Escamilla-Morgado of Mission.

“A preliminary investigation revealed that a gray Ford Fusion was traveling southbound on the northbound lane of Moore Field Road,” the news release stated.

“A black Chevrolet Blazer was traveling northbound and took evasive action to drive onto the southbound lane to avoid colliding with the Ford. The driver of the Ford corrected his path of travel onto the southbound lane and collided with the Chevrolet head-on, the release added.”

The driver of the Ford, later identified as Escamilla-Morgado, died at the scene. The driver of the Chevrolet, who was not identified, was transported to DHR Health for medical evaluation, according to the release. No additional information on his condition was provided.
