Can you seek compensation from a dead defendant?

Yes, you can file a personal injury claim against the estate of a deceased defendant by suing the estate directly through a personal representative appointed by a court.

In a personal injury claim against a deceased defendant, the personal representative (such as an executor or administrator) is the individual legally responsible for managing the deceased’s estate. This person acts on behalf of the estate, including handling legal actions like defending a lawsuit, managing assets, paying debts, and distributing remaining property according to the will or state law.

The claim against the deceased defendant will proceed against their estate, represented by the personal representative, who will defend the case and use estate assets to satisfy any judgment.

The lawsuit essentially pauses until the estate is settled. Recoverable damages are limited to the deceased’s assets or insurance policy, and you may not receive punitive damages.

How to proceed with a claim

  • Identify the estate: You must identify the deceased defendant’s estate as the defendant.
  • Obtain a personal representative: The court will appoint a personal representative (also known as an executor or administrator) to manage the estate’s affairs.
  • Start the lawsuit: The claim can proceed either by intervening in the pending probate action or by filing a separate civil lawsuit against the estate.
  • Follow state-specific procedures: Procedures and timelines, such as statutes of limitations, can vary by state, so it’s crucial to consult with a lawyer who specializes in your state’s laws.

What to expect

  • Pause in proceedings: The lawsuit will be paused temporarily (automatic stay) after the defendant’s death, allowing time for the estate to be settled and a representative to be appointed.
  • Limited recovery: Damages are limited to the assets in the estate and the deceased’s insurance policy.
  • No punitive damages: You will not be able to collect punitive damages because the deceased cannot be punished.
  • Case complexity: The case may become more complicated. Evidence from the deceased defendant may not be automatically admissible in court, and the estate may resist settling, especially if there are limited assets.

If the victim dies from the injury

  • Wrongful death claim: If the defendant’s actions directly caused the victim’s death, the case will likely become a wrongful death claim filed by the surviving family members to recover damages such as medical expenses, funeral costs, and lost financial support.
  • Survival Action: The estate may also file what’s called a survival action on behalf of the deceased victim to recover damages incurred before death, such as medical expenses, pain and suffering, and lost income.

One man killed, another injured in South Texas crash

By: Benjamin Trevino

JIM WELLS COUNTY — A collision involving multiple vehicles near Alice left one man dead and another injured. This, according to a new release from the Corpus Christi office of the Texas Department of Public Safety,

The crash happened about 12:45 p.m. November 29 on US-281 northbound lanes just outside of Alice.

According to the report, 51-year-old Lee Roy Rodriguez of McAllen was driving a 1999 Toyota Solara southbound on US-281 in a reckless manner. Troopers were alerted to a driver making frequent lane changes and were trying to locate the vehicle.

However, before troopers arrived, the Solara hit the rear of a semi-trailer, causing the rig to spin and roll over as the Solara careened across the grassy median and into the northbound lanes.

Investigators say the Solara then hit a 2019 GMC Sierra head-on, causing the Solara to burst into flames.

Rodriguez was pronounced dead at the scene. The driver of the Sierra was identified as 29-year-old Brian Cisneros of Edinburg. At this writing, he was hospitalized in undetermined condition. The driver and passengers of the truck tractor were uninjured in the crash, the release added.
