Who Pays for Damages in a Hit-and-Run Crash?
Establishing who will pay for your damages in a hit-and-run accident can be challenging. This is especially true when the at-fault driver is never found. Fortunately, all hope is not lost, because there are legal ways to seek compensation for your injuries, vehicle damage, and other losses.
Uninsured Motorist Coverage
The State of Texas does not require all drivers to have uninsured motorist coverage. However, leasing companies and other lenders might require it as a condition of approving the financing. Check your loan or lease agreement: Review your specific contract to see if UM/UIM coverage is required.
If you have UM coverage, it can step in to cover your damages and injuries in a hit-and-run accident. A personal injury lawyer like those at the J. Gonzalez law Firm can review your policy to help determine your available options.
Personal Injury Protection (PIP) Coverage
In Texas, Personal Injury Protection (PIP) is also an optional auto insurance coverage that pays for medical expenses and lost wages for you and your passengers, regardless of who is at fault. While Texas law requires insurers to offer a minimum of $2,500 in PIP coverage with a liability policy, you can purchase higher limits. PIP covers immediate medical costs like ambulance rides and rehab, as well as up to 80% of medical bills and 60% of lost wages, up to your policy’s limit.
Again, the personal injury attorneys at the J. Gonzalez Law Firm can review your policy and advise you of your options.
Filing a Lawsuit against the At-Fault Driver
If the hit-and-run driver is eventually identified, you may be able to file a personal injury claim against their insurance company, and if that is not an option, you may be able to file a lawsuit to hold them accountable. This can cover a wide range of damages.

Laredo police charge man who fled accident scene
By: Benjamin Treviño
Laredo police arrested a 21-year-old man after he allegedly left the scene of a crash.
According to a Laredo Police Department news release, the incident happened October 30 at 44:47 p.m. The report states officers were called to the intersection of Carriers Dr. and South Unitec Dr. after a caller reported a hit-and-run car crash.
A man driving a white Ford Taurus told officers he had been traveling east on Carriers when a white Ford Fusion heading west crossed into his lane and struck his vehicle, according to police.
The Taurus hit the curb and came to a stop after its tires were blown out, police said. Two men in the Fusion reportedly exited the vehicle, spoke briefly, then got back into the car and drove off. Both front tires of that vehicle were also blown out, according to police.
Officers traced the suspect vehicle to an address in the 500 block of Callaghan Street. They later located its driver at his workplace in the 1300 block of Uniroyal Drive, where he was arrested, police said.
Jail records show the man, whose name was not disclosed, was booked and released Oct. 31 on a Class B misdemeanor charge of accident involving damage to a vehicle.
In Texas, a Class B misdemeanor can result in a punishment of up to 180 days in jail, a fine of up to $2,000, or both
