Can passengers file a claim their driver for personal injury?
Yes, passengers who are injured in a crash can seek compensation from the driver if the driver’s negligence caused the accident. This is true even if the driver is a friend or family member.
Passengers can seek compensation from the driver’s insurance policy for medical bills, lost wages, and other damages. In some cases, a passenger can also sue the other driver if they were at fault, or multiple parties if fault is shared.
Who to sue
Injured parties can sue the driver of the car they were in If the driver’s negligence caused the accident. The process can begin by filing a claim against the driver’s insurance company.
Victims can also sue the other driver if the other driver was at fault. If both drivers share blame, victims can file a claim against both insurance policies.
In some situations, a third party like a vehicle manufacturer or a government entity responsible for road hazards may be liable.
What damages can be recovered?
Damages that can be recovered include:
· Medical expenses, including future care for long-term injuries
· Lost wages
· Pain and suffering
· Other out-of-pocket expenses, such as property damage to personal items like a phone or glasses
Time limits:
There are strict deadlines, known as statutes of limitations, for filing a personal injury lawsuit. In Texas, the statute of limitations is two years from the date of the crash.
Insurance limits:
An insurance policy has a maximum amount it will pay out. If your damages exceed this limit, you may need to file a lawsuit against the driver directly.

A motorcyclist is facing an intoxication assault charge in connection with a crash that left his passenger with serious injuries.
The September 16 crash happened around 2:25 a.m. in the 5500 block of South I-69C in Edinburg.
According to Edinburg Police, Miguel Angel Garcia was driving in the northbound lanes of the highway when his motorcycle struck the rear of a Ford SUV. It was not immediately clear what caused the rear-end collision.
Garcia sustained lacerations to his face and head, and asphalt burns, according to police. His unidentified female passenger suffered spinal fractures, and fractures in her right leg.
According to an affidavit obtained by Channel 5 News, Garcia displayed “red, glossy, watery, bloodshot eyes.” However, results of a toxicology test were pending at this writing.
