Can a car passenger’s family file a wrongful death lawsuit if the passenger dies in an accident?
The short answer is yes, but the family, as plaintiffs, must ultimately prove that the death was caused by the defendant driver’s negligence.
Who Can Sue?
In Texas, eligible family members who can file a wrongful death lawsuit include the surviving spouse, the deceased’s children, parents, or the deceased’s personal representative.
Who Is Liable?
A wrongful death claim can be filed against the person responsible for the fatal accident, which may include:
The At-Fault Driver: A driver who was speeding, distracted, intoxicated, or otherwise negligent could be held responsible.
A Vehicle Manufacturer: If a defective car part or system contributed to the accident, the manufacturer could be liable.
What Can the Family Recover?
Eligible family members can seek compensation for their losses, including the following:
· Medical expenses the deceased incurred before their death.
· Funeral and burial expenses.
· Lost wages and income the deceased would have earned.
· Compensation for the pain, suffering, and loss experienced by the family due to the deceased’s absence.
Key Steps to Take:
Contact the J. Gonzalez Law Firm. We can determine your eligibility to file a lawsuit, and if you are eligible we investigate the accident, represent you in settlement negotiations, and represent you in court if necessary.
If you retain us as your legal representative, we can help collect evidence related to the accident, which may include the police report, witness statements, and expert testimony.
You should know that Texas tort laws have a two-year statute of limitations. That means family members must file their lawsuit within two years of the victim’s date of death, so it’s important to retain an attorney as soon as possible.
