Fatal traffic accidents cause enormous devastation for grieving family members who are left behind.

They have to cope with the loss of a loved one, deal with funeral expenses, and piece together a broken family.

In these circumstances, a wrongful death lawsuit can be brought to recover any financial losses created by the death. A wrongful death suit may be brought by the surviving children, the surviving spouse, and even the parents of the deceased. If none of the individuals entitled to bring an action do so within three months of the injured individual’s death, the executor or administrator can bring the action, unless requested not to by all those individuals.

Additionally, a parent or legal guardian of the children can file a personal injury claim on behalf of any minor children who were hurt in the crash.

The objective of wrongful death claims and personal injury claims are essentially the same. They both seek to compensate victims for losses incurred because of the negligence of someone else. Losses can include medical expenses, pain and suffering, loss of income, loss of companionship, and more.

The deadlines are different for a wrongful death lawsuit, and a personal injury lawsuit. In a wrongful death case, the deadline is usually three months from the date of the victim’s death. Personal injury lawsuits must be filed within two years of the date the injury occurred.

Children who have lost a parent can experience a range of emotions, including grief, anxiety, and fear about the safety of their remaining parent or guardian. It’s important to provide them with emotional support and understanding.

A 76-year-old La Blanca man is dead after being struck by an alleged intoxicated driver. The incident happened about 5:16 p.m. November 24, according to a Texas Department of Public Safety news release.

The release states that 76-year-old Joe Davila was taking trash to his garbage bin on SH 107 and FM 493 when a gray Nissan veered off the roadway and into a bar ditch, hitting Davila.

“The driver of the Nissan did not stop and fled the scene,” the release stated.

“A witness followed the Nissan, and moments later, with the assistance of a Hidalgo County Sheriff’s Deputy, the suspect was apprehended at a nearby business parking lot,” the report added.

The driver has been identified as 33-year-old Alamo resident Humberto Isaac Garza. He has been charged with intoxication manslaughter and collision involving injury or death.
