A look at the Complexities of Big Rig Crashes

By: Benjamin Treviño

In personal injury cases involving two big rigs, liability is often split between multiple commercial entities. These include drivers, trucking companies, and maintenance providers. Because these accidents involve vehicles weighing up to 80,000 pounds, injuries are typically catastrophic and settlements can range from $100,000 to several million dollars.

Potentially Liable Parties

Drivers

Truck drivers do important work that keeps the country clothed, fed, and supplied with the tools workers need to do their jobs. However, truckers can be found partially or completely liable for crashes if they engage in negligent behavior behind the wheel. Truckers who violate traffic laws for speeding, those who drive longer than legally allowed, and those text while driving can find themselves on the liability hook if they cause a crash.

Trucking Companies

Trucking companies can also face the burden of liability for practices such as negligent hiring, training, or forcing drivers to exceed federal hours-of-service limits.

Maintenance Companies

If mechanical failures like brake or tire blowouts caused the crash, the garage or maintenance company might be found liable if it can be shown that its mechanics performed faulty repairs.

Cargo Shippers/Loaders

Warehouse companies could share part of the blame for a crash for improperly secured loads. These can cause sudden shifts in weight that can lead to rollover accidents.

Common Catastrophic Injuries

Crashes involving 18-wheel trucks and other large vehicles often lead to injuries that are more catastrophic than passenger vehicle crashes. The reason is the sheer weight of the vehicles involved in big rig accidents. Common injuries from these crashes include:

  • Traumatic brain injury (TBI)
  • Permanent cognitive impairment
  • Spinal cord damage
  • Paralysis
  • Amputations of arms and legs
  • Internal organ damage
  • Severe blunt force trauma

CONVERSE – An April 28 crash involving a crane truck and an 18-wheeler shut down a northeast portion of Loop 1604.

News reports indicate the crash happened around 2:00 a.m. near the Rocket Lane exit in Converse.

According to Converse police, a crane truck struck an 18-wheeler that was stopped on the side of the road. The impact ripped open the side of the 18-wheeler’s trailer and damaged the cab.

Both drivers were reportedly taken to the hospital with injuries, but police say none appear to be life-threatening.

Eastbound lanes of Loop 1604 were shut down for the better part of the afternoon as crews worked to clear the scene.
