A reminder about Texas motorcycle helmet laws

Texas law does not require motorcycle riders who are at least 21 years old to wear a helmet as long as they meet one of two requirements. They must have completed a motorcycle safety course or have $10,000 of medical insurance covering injuries.

Key Penalties and Consequences

Violation of Texas motorcycle helmet laws can carry the following penalties.

  • Fines: Generally $10–$50 per violation.
  • Insurance/Permit Issues: Riders under 21 or those with only a learner’s permit may face higher fines, potentially up to $250.
  • Insurance Penalty: Without proof of required insurance, you may be cited for failure to maintain financial responsibility, with fines of $315 or more.
  • Civil Liability: Failure to wear a helmet can be used to show that a rider was partially responsible for their own injuries, reducing compensation in a personal injury lawsuit,

Wearing Protective Gear is Recommended

Regardless of the law, the J. Gonzalez Law Firm recommends that motorcycle operators and passengers wear protective gear anyway. That includes a DOT/ECE-approved helmet, armored jacket, riding pants, abrasion-resistant gloves, and over-the-ankle boots.

Studies show that the risk of severe injuries to motorcyclists wearing safety gear drops significantly compared to unprotected riders. Helmets are especially important.

Non-helmeted riders are three times more likely to sustain traumatic brain injuries.Helmets also reduce the risk of head injury-related mortality by more than half, according to Eastern Association for the Surgery of Trauma (EAST).

Negligence Happens

Motorcyclists who wear protective gear are still prone to injury due to the negligence of other riders and motorists. If this should happen to you, the personal injury attorneys at the J. Gonzalez Law Firm are here for you.

They have decades of experience analyzing motorcycle crash evidence, such as skid marks, debris, and surveillance footage.

Our experts can reconstruct the crash using scientific principles to recreate the accident scene to determine how it happened. We can also evaluate rider behavior, reaction times, and potential distractions to determine the sequence of events.

Mechanical failures are also studied to determine of any component defects may have contributed to the crash. This includes components on the motorcycle and those on another vehicle that may have been involved in the crash.

The J. Gonzalez Law Firm also reviews road and environmental conditions. We consider factors like weather and road surface conditions that may have affected the accident.

If necessary, we can provide expert testimony in court to help explain complex technical aspects of the crash to a jury.

All of these aspects of the investigation help us determine liability. That, coupled with analysis of medical care following the crash, ensure that we achieve the maximum settlement that is legally possible.

Motorcyclist dies in rural Donna crash

By: Benjamin Treviño

A March 15 car-motorcycle collision in rural Donna has claimed one man’s life.

The Texas Department of Public Safety has identified the victim as 21-year-old Donna resident Christopher Rosas.

The crash happened at about 11:27 p.m. on Mile 9 North on Hutto Road and Fogata Avenue, according to a DPS report.

The report states that Rosas was traveling north on Hutton Road on a black 2006 Kawasaki motorcycle. Rosas allegedly failed to control his speed and crashed the motorcycle into the rear of a gray 2018 Dodge Charger.

The car was occupied by a female driver and two children. They were not injured, according to the report.

“The motorcycle rider was ejected from the Kawasaki, went airborne over the Dodge, and landed on the ground,” the DPS report said.

The crash was still under investigation as of this report.
