Liability in Chain-reaction Accidents

In a car accident where one car hits your car, and you then hit a third car, the driver who initially rear-ended you is generally considered at fault for the entire sequence of events.

This is because the driver whose car hit yours failed to maintain a safe following distance, causing the initial impact that led to the domino effect. However, under certain circumstances, you and the third driver could share responsibility.

You and the lead driver may share some liability if your driving behavior, such as tailgating or having no brake lights, contributed to the second collision. The driver of the third car might sue both you and the initial driver.

Shared Liability: A court can determine that multiple drivers are at fault and assign a percentage of liability to each driver involved, according to the Steinberg Law Firm.

Steps to Take After the Accident

Ensure Safety: Confirm everyone is safe and seek medical attention for any injuries.

Gather Evidence: Document the scene, damage, and take photos.

Obtain Information: Get contact and insurance information from all other drivers.

File Police and Insurance Reports: Contact law enforcement to file a report and then contact your insurance company as soon as possible.
